In this agreement; “Buyer” states the Members who signed up the Site and whose Membership is approved and who buys the goods over the Site which are put up for sale on the Site within the scope of the provisions of Remote Sales Agreement by monarchlondon.co; “Content” states all kinds of visual, literary and auditory images such as all kinds of designs, logos, signs, information, files, pictures, music, numbers and others which are published on the Site or to which the access is available. “Reliable Electronic Trade System (RET System)” states the service provided by monarchlondon.co and the related bank within the conditions that are specified on this Agreement intended for executing the “payment” related section of the sales agreement that is concluded between the Buyer and monarchlondon.co; “Reliable Account” states the escrow account in which the payments that are made by the Member/Buyer are kept in RET System; “Service” states the services which are provided to the Members by monarchlondon.co within the scope of this agreement and for whose content monarchlondon.co always has a right to make amendments; “User” states the real and regal entities who accesses the Site online and who benefit from the Services that are provided within the conditions that are specified on this Agreement; “Online Sale” states the sales of the goods that are made over the Site within the scope of the Remote Sales Agreement; “Site” states the website formed of the www.monarchlondon.co zone name and of the sub zone names subjected to this zone name and through which the value added services which are formed in connection with this site are provided; “monarchlondon.co Interface” states the internet pages which are used primarily for the purpose that the content formed by the Members can be seen by the Users and that monarchlondon.co database can be investigated, which are protected within the scope of the 5846 numbered Code of Intellectual and Artistic Works and which issues a commend to the computer software in order for all kinds of transactions to be carried out that can be done over the Site within the designs of whose all intellectual properties belong to monarchlondon.co; “monarchlondon.co Membership Account” states the internet pages special to the members on which the Members can carry out the transactions that are necessary for the members to benefit from the services provided on the site, can view the goods, can participate in the voting about the goods and can buy the goods put up for sale and which can be accessed through the “user name” and “password” that are only determined by the members and undertaken to be used solely by the members; “monarchlondon.co Database” states the database in which the content that can be accessed within the site is stored, sorted out, investigated and accessed, which belongs to monarchlondon.co and which is protected as per the 5846 Numbered Code of Intellectual and Artistic Works; “Member” states the real and legal entities who sign up the site under the conditions that are determined by monarchlondon.co and whose membership is approved also by monarchlondon.co and who benefit from the Services that are provided on the site within the conditions determined by monarchlondon.co (membership involves the Buyer also); “Membership Information” states user name, password and/or pass code and other information which enables the Members to access to the site.


INFORMATION NOTICE UNDER THE LAW ON THE PROTECTION OF PERSONAL DATA


As Monarch, acting as a data controller under the Law No. 6698 on the Protection of Personal Data (KVKK), we would like to inform our customers and visitors regarding their rights and our obligations.



1. Collection and Processing of Personal Data


Your personal data, such as your identity information (Name, Surname, Turkish ID Number), contact information (Email address, physical address, phone number, and IP address), information regarding the product you purchased under Monarch’s business activities, and audio data recorded during customer service calls, are collected directly from you through various channels, including but not limited to your visit to our website, your membership registration, e-newsletter subscription, phone or email correspondence, or product purchases from Monarch's website, or by entering into a commercial or legal relationship with Monarch by other means. These data will be processed in accordance with the legitimate purposes set out in Article 5(2) of the Law, such as the establishment and performance of the contract, fulfillment of legal obligations, management of requests and complaints, and without violating your fundamental rights and freedoms.

Additionally, personal data reflecting your preferences, interests, and usage habits with respect to the products and services offered by Monarch, may also be processed through cookies during your visit to our website, ensuring you enjoy our products and services without any issues and enhancing our product and service offerings without infringing on your fundamental rights.



2. Legal Grounds for Processing Personal Data


For any personal data not covered under one of the legal grounds stipulated in Article 5/2 of the Law, we will seek your explicit consent as a legal requirement. Additionally, we will request your consent to send commercial electronic messages (SMS, email, mobile push notifications, instant messages). You will be able to provide this consent by ticking the relevant boxes and pressing the “Sign Up” button when accepting the membership agreement and this information notice on our website.

Your name, surname, and contact details (phone number, mobile number, email address) will be processed within the scope of your consent for the purpose of sending commercial messages related to our products and services, including advertisements and promotions. You may provide this consent by marking the relevant boxes on our website and pressing the “Sign Up” button.



3. Sharing and Transfer of Personal Data


Your personal data, as outlined above, may be shared with public authorities or institutions authorized to request such data under legal obligations, as well as with institutions within Turkey that we have agreements with in the course of our activities, our suppliers, business partners, and third-party service providers we collaborate with, all within the framework of personal data processing conditions specified in Articles 8 and 9 of the Law and in line with the purposes described above, and with sufficient and effective security measures in place.



4. Your Rights Under the Law


As a personal data owner, you have the following rights under the Law No. 6698. To exercise these rights, you may submit your request in writing by completing the personal data application form published at www.monarchofficial.com or by submitting the mandatory information contained in the form through another written document. You may also send your request using your registered electronic mail (KEP) address, secure electronic signature, mobile signature, or via the email address you have previously registered with Monarch, allowing your identity to be verified. Monarch will process your request free of charge within thirty days, depending on the nature of the request. However, if the request incurs additional costs, a fee may be charged according to the tariff determined by the Personal Data Protection Board.


In this context, you have the right to:

  • Learn whether your personal data has been processed,

  • Request information regarding the processing of your personal data,

  • Learn the purpose of processing your personal data and whether it is being used in accordance with that purpose,

  • Know the third parties to whom your personal data has been transferred, whether domestically or internationally,

  • Request correction of incomplete or inaccurate data and request notification of this correction to third parties to whom the data was transferred,

  • Request the deletion or destruction of your personal data if the reasons for processing no longer exist, and request notification of this action to third parties to whom the data was transferred,

  • Object to decisions made solely based on automated systems that negatively affect you,

  • Request compensation for damages incurred as a result of unlawful processing of your personal data.
